1. Acceptance of Terms & Eligibility
By creating an account, browsing, or using CuratedLists (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, along with our Privacy Policy. If you do not accept all of these terms, you must immediately discontinue use of the Platform.
Age & Age-Gated Sensory Categories
- You must be at least thirteen (13) years of age (or sixteen (16) in jurisdictions requiring such age for online consent) to create an account.
- Alcohol & Age-Restricted Tasting Rosters: Certain rosters and evaluation templates involve beer, wine, distilled spirits, or other adult beverages. You affirm that you are of the legal drinking age in your country or state of residence (e.g., 21 years of age in the United States) when evaluating, viewing, or publishing alcohol-related rosters.
2. User Accounts & Authentication
To access full platform functionality, such as creating evaluation rosters, recording tasting notes, and personalizing SABCD tier boards, you must register using passwordless email magic links or authorized third-party OAuth providers.
- Account Integrity: You agree to provide accurate, truthful, and up-to-date information during registration. You may not impersonate any person or entity.
- Security: You are solely responsible for maintaining the confidentiality of your authentication devices and sessions. You agree to notify CuratedLists immediately upon detecting any unauthorized access or compromise of your account.
- Usernames & Vanity Slugs: We reserve the right to reclaim, suspend, or reassign usernames or vanity slugs (such as
/@username) that infringe trademarks, are offensive, or are maintained solely for squatting purposes.
3. User-Contributed Content & Intellectual Property Licenses
CuratedLists is an enthusiast platform powered by community tasting notes, barcode data, packaging photographs, and sensory radar evaluations. This section outlines your ownership rights and the licenses you grant to make the platform operate.
3.1 Retention of User Ownership
You retain complete copyright and all other intellectual property rights in and to your original user-generated content, including subjective tasting notes, written flavor commentary, and original photographs taken and uploaded by you ("Contributed Content"). CuratedLists does not claim copyright ownership over your creative prose or photography.
3.2 Broad Platform License Grant
By submitting, scanning, uploading, or displaying Contributed Content on or through CuratedLists, you hereby grant CuratedLists a worldwide, perpetual, irrevocable, royalty-free, fully paid-up, transferable, and sublicensable (through multiple tiers) non-exclusive license to use, host, cache, store, reproduce, modify, format, adapt, publish, translate, aggregate, create derivative works from, publicly display, and distribute such Contributed Content across any media format and distribution channel now known or hereafter devised.
3.3 Public Discovery Indexes & Commercial B2B Developer APIs
You expressly acknowledge and agree that the license granted in Section 3.2 permits CuratedLists to:
- Index, categorize, and showcase your public evaluations across community discovery rosters, search engine results, and public vanity URLs (
/@username/slug). - Compute, normalize, and mathematically aggregate your evaluations with scores submitted by other community members to generate community consensus benchmarks and Composite Benchmark Indices (CBI).
- Commercial B2B APIs: Package, syndicate, license, and commercialize aggregated benchmark data, sensory profile polygons, and verified barcode catalog metadata through developer REST/GraphQL APIs and enterprise data feeds to commercial third parties, retailers, distributors, and culinary publications without compensation to you.
3.4 Persistence of Universal Barcode & Product Catalog Data
Product barcodes, retail packaging photographs, manufacturer titles, ingredient lists, and foundational catalog metadata contributed by you become part of the universal shared CuratedLists Product Graph.
Account Deletion & Deactivation: In the event you deactivate or delete your user account, your personal identifying information and individual tasting notes will be removed or anonymized per our Privacy Policy. However, universal barcode mappings, packaging imagery, and anonymized numeric score contributions will persist indefinitely within the shared catalog to preserve platform integrity for other users.
4. CuratedLists Intellectual Property
The CuratedLists service, including our trademarks, branding, visual designs, interactive SVG radar visualization algorithms, Composite Benchmark Index (CBI) mathematical formulas, Edge cache revalidation architecture, and software code, is and shall remain the exclusive intellectual property of CuratedLists and its licensors.
Except for the limited license granted to access and use the Platform in accordance with these Terms, no right, title, or interest in or to our intellectual property is transferred to you.
5. Acceptable Use & Scraping Prohibitions
You agree to use CuratedLists only for lawful purposes and in accordance with community standards. You explicitly agree that you shall NOT:
- Automated Scraping & Data Harvesting: Use any automated robot, spider, scraper, crawler, or script to extract, download, or index proprietary sensory radar coordinate geometries, composite ranking tiers, or user profiles without our prior written authorization.
- Fraudulent Barcode Mappings: Submit falsified, misleading, deceptive, or spam barcode-to-product associations.
- Harmful Content: Upload, post, or transmit any material that is defamatory, obscene, pornographic, harassing, threatening, or infringing upon third-party intellectual property or publicity rights.
- Infrastructure Interference: Attempt to probe, scan, or compromise our edge runtime infrastructure, circumvent rate limits, inject malicious payloads, or disrupt platform availability.
6. Barcode Cache & Third-Party Services
The Platform provides edge barcode lookups that aggregate catalog data from global retail registries, Open Food Facts, and user submissions.
CuratedLists does not guarantee the completeness, manufacturer verification, allergen accuracy, nutritional validity, or availability of any product identified through barcode scanning. Users are advised to inspect physical product packaging for verified allergen and nutritional statements.
7. Disclaimers of Warranties ("As-Is")
Please read this section carefully as it limits the liability of CuratedLists.
THE SERVICE AND ALL CONTENT, RADAR VISUALIZATIONS, BARCODE LOOKUPS, AND TIER RANKINGS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR FREEDOM FROM PROGRAM ERRORS.
WE DO NOT WARRANT THAT THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR ERROR-FREE, NOR DO WE WARRANT THAT ANY DEFECTS WILL BE CORRECTED IMMEDIATELY.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CURATEDLISTS, ITS FOUNDERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE;
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
- ANY CONTENT OR SENSORY SCORES OBTAINED FROM THE SERVICE; OR
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00 USD) OR THE TOTAL AMOUNT PAID BY YOU TO CURATEDLISTS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to defend, indemnify, and hold harmless CuratedLists, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your Contributed Content; (c) your violation of these Terms; or (d) your infringement of any third-party rights.
10. Termination & Account Suspension
We reserve the right, without notice and at our sole discretion, to terminate or suspend your account and right to use the Platform for conduct that we determine violates these Terms, is harmful to other users, or damages CuratedLists or third parties.
You may discontinue your use of CuratedLists and request deletion of your account at any time through Account Settings or by emailing support [at] curatedlists.app. Sections 3, 4, 7, 8, 9, and 11 shall survive any termination.
11. Governing Law & Dispute Resolution
These Terms and any disputes arising out of or related to them or the Platform shall be governed by and construed in accordance with the laws of the State of Texas, United States, without giving effect to any principles of conflicts of law.
You and CuratedLists agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Travis County or Harris County, Texas, to resolve any dispute, controversy, or claim arising out of these Terms.
12. Modifications to Terms
We reserve the right to revise or replace these Terms at any time in our sole discretion. When changes are made, we will update the "Last Updated" date at the top of this document. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the modifications.
